Terms of Service

1. Who we are

Gather (“we”, “us”) is a service that helps small, private circles of family and friends coordinate plans and shared events. These Terms of Service (“Terms”) govern your access to and use of Gather, including the website at zuccigather.com and any related mobile apps (collectively, the “Service”).

By using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

2. Your account

You must be at least 13 years old to use Gather. Accounts are created via magic-link or one-time-code sign-in; you’re responsible for keeping your email inbox secure. You’re responsible for activity that happens under your account.

Circles are invite-only. You may be added to a circle by an existing admin, or you may create your own circle and invite others. Circle admins control membership for their circles.

3. Subscriptions and billing

Gather has a free tier and a paid tier called Gather Plus. Current pricing and what each tier includes are at /pricing. Prices may change; we’ll give you reasonable notice before any price change applies to your existing subscription.

Gather Plus is billed through Stripe on a recurring monthly or annual basis depending on the plan you choose. Subscriptions auto-renew at the end of each billing period until cancelled. You can cancel anytime from your profile page; your plan stays active through the period you’ve already paid for, then drops back to the free tier.

All fees are in US dollars and are non-refundable except where required by law. If we offer a promotion, refund, or credit, it applies only to the specific terms stated.

4. Acceptable use

When using Gather you agree not to:

  • Harass, threaten, or abuse any person.
  • Share content that’s unlawful, deceptive, or infringes another person’s rights.
  • Attempt to access accounts, circles, or content that isn’t yours, or probe the Service for vulnerabilities without prior written permission.
  • Use Gather to distribute spam, chain messages, or commercial solicitations.
  • Use Gather as a public events platform, marketplace, or broadcast channel. Gather is deliberately private and small-group.
  • Scrape, reverse-engineer, or attempt to extract data from the Service outside of the export mechanisms we provide.

We may suspend or terminate accounts that violate these rules or the spirit of Gather as a quiet space for small, private groups.

5. Your content

You own the content you post on Gather (plans, comments, photos, mascot configurations, etc.). By posting, you grant Gather a limited, worldwide, royalty-free license to host, display, and transmit that content solely to run the Service (for example, showing your plan to the people in your circle, sending email notifications about it, or generating calendar invites).

This license ends when you or your circle admin deletes the content, except for anonymized aggregate data and backup copies that naturally take time to purge from our systems.

You’re responsible for the content you post. Don’t post other people’s personal information (home addresses, phone numbers, photos) without their permission.

6. Intellectual property

The Service, including its software, mascots, designs, and brand, is owned by Gather and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable license to use the Service as provided by these Terms.

Mascots, themes, and other cosmetic content that may be offered for purchase are licensed to you for personal use inside the Service; they’re not transferable outside Gather.

7. Termination

You can stop using the Service at any time by signing out. You can request full account deletion by contacting the address on your receipt or your inviter.

We can suspend or terminate your account if you violate these Terms. If we terminate your account without cause, we’ll refund any prepaid subscription fees for the unused portion of the period.

8. Disclaimers

The Service is provided “as is” and “as available”. Gather disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Gather coordinates around events but does not guarantee that events will happen, that tickets will transfer, or that plans will be attended. Coordination is the responsibility of the people involved.

9. Limitation of liability

To the fullest extent permitted by law, Gather’s total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid Gather in the twelve months before the event giving rise to the claim, or one hundred US dollars, whichever is greater.

Gather is not liable for indirect, incidental, special, or consequential damages.

10. Changes to these Terms

We may update these Terms from time to time. If a change is material, we’ll give reasonable notice before it takes effect (for example, by email or an in-app banner). Continuing to use the Service after a change means you accept the updated Terms.
